0. Preamble

The purchase of a good or service from Goodbye Comfort Zone constitutes full implicit acceptance of these general terms and conditions without reservation, so it is important for the customer to read them before placing any order.

1. Fields of application

These general terms and conditions of sale apply to all transactions concluded through the Goodbye Comfort Zone websites accessible at: www.goodbyecomfort.zone.

A "customer" is any individual or legal entity placing an order with Goodbye Comfort Zone that has been validated via our secure payment platform, or by cheque or cash.

2. Public concerned and age limit

Goodbye Comfort Zone is dedicated to offering a range of products and services reserved for individuals and professionals. These tools, training, and other products and services are designed to meet our goal of making surpassing oneself more fun and engaging.

The participation of minors implies the explicit agreement of parents or guardians, and can only be done under their supervision and after explicit agreement of the company Goodbye Comfort Zone.

Goodbye Comfort Zone does its best to restrict access to its sites, products and services to minors. Even if the content of products and services is not of a shocking nature, Goodbye Comfort Zone prefers to address a mature audience capable of understanding the implications and responsibilities of the business world.

Any subscriber to the newsletter who does not meet these criteria will be immediately removed from the database as soon as this fact is brought to the company's attention. Similarly, any customer not meeting these criteria will be immediately refunded and a return of the product(s) concerned will be required.

3. Products and services

The products and services comply with current French legislation and the Goodbye Comfort Zone company cannot be held liable in the event of failure to comply with the legislation of another country of destination.

In the event of unavailability of a product or service, the customer will be informed by e-mail and contacted to determine whether the order will be cancelled or transferred to another product or service.

The photos on the site are "presentation suggestions", the images do not always correspond exactly to the product that the customer will ultimately receive or to the events in which he or she may participate. These photos are therefore non-contractual and given as an indication and therefore no claim related to them will be admissible.

In the context of events or training, Goodbye Comfort Zone may be required to make changes to places, dates, times or structures. The customer declares that he accepts this possibility of change without reservation, without the need for prior agreement and without the possibility of requesting a refund or compensation.

4. Awards

Prices are in euros, all taxes included, whatever the country of destination and/or the geographical location of the customer, excluding shipping and order processing costs for products, and for services, unless specifically stated otherwise and, where applicable, excluding travel, food and accommodation costs, which are fully payable by the customer.

Prices may be changed at any time. However, the price applied shall be the price in force at the time of the order.

Any other duties and taxes, whatever they may be (customs, import, local or state taxes, etc.) shall remain, where applicable, entirely the responsibility of the customer, who declares that he accepts this unreservedly as well as the fact of having to carry out, on his own behalf and without any intervention or involvement by Goodbye Comfort Zone, all the necessary legal steps for declaration and payment with the competent authorities.

This rule also applies to any "tax-free" type requests.

5. Payment

When purchasing on the Goodbye Comfort Zone site, payment is due immediately on the date of the order, including for pre-ordered products.

In the case of a secure online payment by credit card, the transaction will be carried out through a specialized company that can ensure that the information transmitted is encrypted by state-of-the-art software, and cannot be read during transport on the network. Any guarantee as to the security of this system is entirely the responsibility of the specialized company and cannot be attributed to Goodbye Comfort Zone.

Unless a specific agreement and/or special offer for payment by instalments has been communicated in advance and/or confirmed in writing by an authorised representative of/by Goodbye Comfort Zone, registration for a training module shall be deemed to be definitive upon receipt by Goodbye Comfort Zone of the full public rate including all taxes, which shall be the trigger for the start of the training course.

Otherwise, Goodbye Comfort Zone reserves the right, without notice or formality, to exclude the participant, without this giving rise to any reimbursement in favour of the customer.

Depending on the products and services, and according to the descriptive specifications linked to them, payment may be made by the means confirmed, accepted and indicated by Goodbye Comfort Zone (credit card, bank transfer, PayPal...).

Furthermore, it is specified that no discount will be granted in the event of early payment and that no interest will be paid by Goodbye Comfort Zone for sums paid by the customer, at any time and in any form whatsoever, in particular for the non-refundable reservation deposit mentioned above.

6. Delivery

The delivery of products is made to the physical or electronic address that the customer will have indicated during the order. The customer is solely responsible for the information he will have communicated. In the event of an error or an address that is not explicit enough, the consequence of which could be an erroneous delivery, Goodbye Comfort Zone may not be held liable.

7. Cancellation, return, refund conditions

As all the programmes and services marketed by Goodbye Comfort Zone fall within the exclusions provided for by the legal frameworks of article L121-20-2 of the French Consumer Code, they are not subject to the 14-day right of withdrawal.

As a reminder, Article L121-20-2 of the Consumer Code excludes, among others, from the legal right of withdrawal:digital content not supplied on a material support whose execution has begun after prior express agreement of the customer and express renunciation of his right of withdrawalthe provision of services, if the execution has begun with the prior express agreement of the consumer.

However, and apart from these legal provisions, Goodbye Comfort Zone has decided to set up internal guarantees subject to conditions of use, the details of which are given below:

A. 14-DAY MONEY BACK GUARANTEE

Following the registration date, the customer has 14 days to try out the concept. During these 14 days, and on condition that they have completed the introductory chapter "The code of your alter ego" by completing and sending the 7 challenges that make up the concept, the customer can request a refund by e-mail to hello (at) goodbyecomfort.zone.

For illustration purposes, here are examples of cases in which this warranty does not apply:

- the customer registers, does not start the program and sends an e-mail to request a refund.

- the customer registers, does not validate any challenge and sends an e-mail to request a refund.

- the client registers, watches the first video briefing and decides it's too hard and quits before completing the 7 challenges in "Chapter 0: The code of your alter ego".

- the customer registers, solely out of curiosity and without the intention of realizing challenges.

- the client does not really test the program and completes the exercises and challenge reports in a hurry without properly completing the challenges.

The Goodbye Comfort Zone programs promote getting out of the comfort zone by experimenting and taking action. This is why they cannot be tested by passive viewing alone, but by the concrete realisation of the challenges presented to unblock the next steps.

To validate the 7 challenges, the client must correctly complete the 7 challenge reports with a minimum of 200 characters and attach a photo to his report to attest to the successful completion of his challenge. Please note that this 14-day guarantee does not include individual coaching services when these have been completed in part or in full.

B. REPAYMENT CONDITIONS

Goodbye Comfort Zone will refund the amount within the legal time limits set out in the Consumer Code and using the same payment method as that used by the customer. Furthermore, all types of benefits and promotional offers of any kind whatsoever that are linked to the original purchase for which the customer asserts his/her right of withdrawal will be automatically cancelled. Furthermore, Goodbye Comfort Zone will not make any refund in the event of absence when the service is provided.

C. EXCLUSIONS

Please note that no refunds will be made for individual coaching services when these have been partially or fully completed.

In the event of unjustified absence or cancellation on the part of the customer for a coaching session less than 24 hours before the session, the session is due, and the advanced fees cannot be subject to reimbursement.Goodbye Comfort Zone can only process one request for reimbursement of a dematerialized or digital product per customer.

Any application that is incomplete according to the above criteria will be rejected and will not be granted.

8. PROTECTION OF PERSONAL DATA, IMAGE RIGHTS AND PROTECTION OF PRIVACY

In accordance with the French Data Protection Act N° 78-17 of 6 January 1978, the customer has the right to access, rectify and delete personal data concerning him/her.

The customer acknowledges having read the personal data protection policy and consents to the collection and use of his data, knowing that it will be treated in a strictly confidential manner.

By entering their information and contact details on the Goodbye Comfort Zone site, customers acknowledge that they agree to receive information/publications from the company by email, post or telephone, and agree to receive the newsletter. They are free to unsubscribe at any time. To do so, simply click on the link at the end of the emails.

Goodbye Comfort Zone informs the customer that it is possible to monitor traffic on all sites. To do this, tools such as Google Analytics or Google Site Optimizer may be used, this list is not exhaustive. This data, which is not nominative, makes it possible to improve the experience of using the Internet sites and to personalise the sites according to the frequent requests of users.

By accepting these general terms and conditions, the customer and/or participant and/or subscriber and/or user implicitly consents to being filmed, photographed and recorded during events organised by Goodbye Comfort Zone.

However, in accordance with the legal provisions stipulated in the context of image rights and the protection of privacy, before any dissemination of an image of the person enabling him or her to be identified, Goodbye Comfort Zone must obtain his or her written consent, specifying the date and place where it was made.

9. INTELLECTUAL PROPERTY

The Internet sites, products and services of Goodbye Comfort Zone, in their entirety, both in their presentation and in their content (in full or separately), whether direct or indirect, in whatever form, are protected by the laws in force on intellectual and/or industrial property.

Any reproduction, and/or distribution and/or communication, and/or representation and/or reuse, and/or adaptation, whether partial or complete, in any form whatsoever, any recording, whether in audio and/or video format, are prohibited, unless expressly authorised in advance by Goodbye Comfort Zone or its assignees, and otherwise constitute an infringement and are therefore liable to the penalties provided for by law.

10. LIMITATIONS AND/OR EXCLUSIONS OF LIABILITY

The customer and/or participant and/or subscriber and/or user declares to acknowledge and/or express and/or accept and/or approve without reservations that :

Any type of content delivered by Goodbye Comfort Zone, in any form whatsoever (ideas, concepts, strategies, advice, etc.) does not give rise to any promise or guarantee of any kind whatsoever (results, gains, benefits, success, performance, etc.).

Goodbye Comfort Zone, its legal representatives, the authorized representatives of/by the company, its partners, its suppliers are not liable or bearers of any promise or guarantee whatsoever.

That the client is therefore solely responsible for the degree of participation/involvement, decisions, actions and results.

That it will not seek in any way to make Goodbye Comfort Zone, its legal representatives, partners, affiliates, suppliers, authorized persons of/by the company, responsible for its degree of participation/involvement, decisions, actions or results.

Goodbye Comfort Zone shall not be held liable, under any circumstances, for any loss or damage caused or alleged to be caused in connection with the use of its advice, products or services, whatever they may be and in any form whatsoever.

Goodbye Comfort Zone does not offer any professional advice of a medical, psychological or financial nature and that any type of content provided by the company, in any form whatsoever (ideas, concepts, strategies, advice, etc...), cannot replace the advice and/or intervention of a professional duly authorised by a diploma recognised by the competent authorities. As a result, the company, its legal representatives, partners, affiliates, suppliers, authorized persons of/by Goodbye Comfort Zone cannot under any circumstances be held liable, in any way whatsoever, for damages of any kind whatsoever (bodily injury, financial damage, illness, death, etc.).

In any event, the liability of the company, its legal representatives, partners, affiliates, suppliers and authorised persons of/by Goodbye Comfort Zone would, where applicable, be contractually limited to compensation that could not exceed the amounts incurred for the purchase of the good or service, whether for damage (even bodily) or loss suffered or other causes.

That it is its sole and entire responsibility to cover itself for potential risks, knowing that Goodbye Comfort Zone is not a subscriber to insurance for medical care, and/or bodily injury and/or disability.

For any dispute arising in connection with the interpretation/execution of the present document, whatever the form thereof, the courts of Paris shall have jurisdiction.

2. PURPOSE OF THIS CHARTER

The purpose of this charter is to inform you about the means we use to collect and process your personal data, in the strictest respect of your rights.

4. THE DATA WE COLLECT

A. Data you provide and reason for collection

When you register, we ask you and we keep: your email address, so that you can connect to the service and so that we can send you content through this channel, your first name, because we are going to exchange together and we are human.

If you pay online, we ask for and keep: your name and mailing address to appear on the invoice.

During your use, we collect and store: your comments and posts on the chat room (if you use this feature), so that it can be read by other members, and so that we can reply to you, what you write to your instructor and your challenge reports (if you use this feature), so that he can validate them and reply to you.

If you benefit from a personal accompaniment by an instructor, we ask you and we keep a phone number and/or a skype ID where we can reach you. If you give your agreement to testify on our site and give your opinion, we collect and keep: your testimony, possibly your photo and/or video testimony.

B. DATA THAT WE COLLECT AUTOMATICALLY AND REASON FOR COLLECTION

When you use the platform, we collect data on your use of the platform: number of connections, first and last visit, programs subscribed to, exercises and challenges validated in each program, start and end dates of programs.

We use this data to: trigger periodic emails and notifications as part of the service and programs, to better support you (e.g., messages of congratulations, encouragement and reminders, reminders about the services you have), to offer you additional services if we think it may be useful to you, to compile statistics on how long it takes registrants to complete the programs, and on the completion rate (to improve our products and services).

5. RECIPIENTS OF THE DATA COLLECTED AND PROCESSED

Only our company's staff, the services in charge of control (especially the auditor) and our subcontractors will have access to your personal data. All our subcontractors adhere to the principle of Privacy Shield, and are in compliance with the European Data Protection Regulation.

We use Hostinger and O2Switch to host our platforms, Crisp to exchange with you, Stripe and Paypal for online payment, Google Analytics and Google Search Console to improve your experience on the site and Mailerlite to send you newsletters.

In the case where access to the platform is offered to you by your company, your company is notified when you start and when you finish a program. We also provide reporting on the use and satisfaction of registrants, which is anonymous.

Your challenge reports and possible written and oral exchanges with the instructors are strictly confidential.

Your personal data may also be sent to public bodies, exclusively to meet our legal obligations, to court officials, judicial officers and bodies responsible for debt collection.

6. TRANSFER OF PERSONAL DATA

Your personal data will not be transferred, rented or exchanged for the benefit of third parties.

7. STORAGE PERIOD OF PERSONAL DATA

A. concerning data relating to the use of the service

Your personal information is kept for a period not exceeding one year beyond the period of use of the service by you, unless you exercise your right to delete your data, under the conditions described below: a longer retention period is authorized or imposed by virtue of a legal or regulatory obligation.

B. concerning credit card data

The financial transactions relating to the payment of purchases and fees via the Site are entrusted to a payment service provider who ensures the smooth running and security of these transactions.

For the purposes of the Services, this payment service provider may be the recipient of your personal data relating to your credit card numbers, which it collects and stores in our name and on our behalf. We do not have access to this data.

2. 365 DAY SATISFACTION GUARANTEE OR 100% REFUND

As part of the exceptional 365-day full Goodbye Comfort Zone Heroes program guarantee, the customer must have followed the entire program of the 6 game modules (in particular by validating all the levels and viewing all the briefing videos) and correctly completed all the exercises and challenges in accordance with the instructions given.

During the 365 days following the date of purchase, once all the modules have been completed and the codes deciphered, the customer will have the opportunity either to discover the secret of the game and access the hidden side of the program, or to unlock the warranty.

Goodbye Comfort Zone advocates getting out of the comfort zone by experimenting and taking action. This is why the program should not be tested only by passive reading but by a concrete realization of the challenges presented to unblock the next steps.

In order to correctly validate all the challenges, the client must fill in all the challenge reports with a minimum of 200 characters and attach a photo to each report to attest to the successful completion of the challenge.

The amount of the refund is equivalent to the amount of the Heroes program, depending on the price and the promotion code in effect at the time of purchase.

By requesting to unlock the warranty, the customer loses lifetime access to the Goodbye Comfort Zone interface, the Mastermind of Legends, the secret chapter of the program, and any other benefits or bonuses offered.

Please note that this 365-day guarantee does not include individual coaching services.

3. CONDITIONS OF REPAYMENT

Refunds will be made by Goodbye Comfort Zone within the legal time limits provided for in the consumer code and via the same payment method as that used by the customer.

In addition, all types of benefits, promotional offers, of any kind whatsoever, which would be linked to the original purchase for which the customer would assert his right of withdrawal will be automatically cancelled.

Furthermore, Goodbye Comfort Zone will not issue any refund in the event of absence at the time of delivery of the service.

4. EXCLUSIONS

Please note that no refunds will be made for individual coaching services when these have been partially or fully completed.

In case of unjustified absence or cancellation by the client for a coaching session less than 24 hours before the session, the session is due, and the advanced fees will not be subject to reimbursement.

Goodbye Comfort Zone shall only be able to process one refund request for a dematerialised or digital product per customer. Any request that is incomplete according to the criteria set out above will be refused and cannot be granted.
